| 德国体育历史上发生过惨痛的兴奋剂事件，这也刺激了其后续加强反兴奋剂机制建设。德国对兴奋剂的治理主要是立法干预与监管，其围绕尊重体育自治和保障运动员权益的核心价值，制定严格的制裁措施，并建立起涵盖德国体育协会内部仲裁、体育仲裁院仲裁、德国法院对体育仲裁的司法审查的救济机制。通过典型的卡特琳·克拉贝案，进一步探讨德国反兴奋剂法治实践的经验、意义。认为德国反兴奋剂治理的法治化建设对我国同样有借鉴价值。指出，我国应进一步完善非法使用兴奋剂的惩罚制度，完善兴奋剂处罚的救济机制，建立仲裁救济机制，加强司法审查机制建设。 |

| Research and Enlightenment of Anti Doping Mechanism in Germany |

| Abstract: |
| In the history of German sports, there have been painful doping events, which also stimulated the subsequent strengthening of antidoping mechanism. The governance of doping in Germany is mainly legislative intervention and supervision. It formulates strict sanctions around the core value of respecting sports autonomy and protecting the rights and interests of athletes, and establishes a relief mechanism covering the internal arbitration of German Sports Association, arbitration of sports arbitration court and relief mechanism of judicial review of sports arbitration by German courts. This paper further discusses the experience and significance of the legal practice of antidoping in Germany through the typical case of Caitlin Crabbe. It is believed that the legalization of antidoping in Germany is also valuable for China. It is pointed out that China should further improve punishment system of illegal use of doping, improve relief mechanism of doping punishment, establish arbitration relief mechanism, and strengthen the construction of judicial review mechanism. |
