竞争政策作为市场化配置资源的重要制度安排,在党的十八大后被确立为基础地位并不断得到强化。我国体育场馆运营机制改革初步实现结果意义上的市场化,但尚未实现行为与过程意义上的市场化。行政垄断等排斥、限制竞争的现象仍较为严重,歧视性市场准入导致场馆市场分割,政府规制越位压制自主经营空间,政府规制低效增加制度变革成本。新时期,场馆市场规制亟需实现从管控性规制向竞争性规制的重大转型,将竞争纳入规制框架体系,推动场馆规制方式从选择性转向竞争中性,规制流程从事前审批转向后置监管,规制工具从命令控制型转向市场激励型。在具体实施路径上,以深化管办分离为核心培育竞争主体,以落实公平竞争审查为核心清除制度壁垒,以实施竞争倡导为核心破除观念束缚,以提升竞争执法能力为核心加强组织建设。 |

As an important institutional arrangement for market-oriented allocation of resources, competition policy has been established as the basic position and continuously strengthened after the 18th the 18th party congress. The reform of China’s stadium operation mechanism has initially realized the marketization in the sense of result, but has not yet realized the marketization in the sense of behavior and process. The phenomena of exclusion and restriction of competition such as administrative monopoly are still serious. Discriminatory market access leads to market segmentation of venues. The offside of government regulation suppresses the space of independent operation, and the inefficiency of government regulation increases the cost of institutional change. In the new era, the regulation of the venue market urgently needs to achieve a major transformation from regulatory regulation to competitive regulation, incorporate competition into the regulatory framework system, promote the regulation of venues from selective to competitive neutrality, the regulatory process from pre-approval to post-regulation, and the regulatory tools from command control to market incentive. On the specific implementation path, we should cultivate competition subjects with deepening the separation of management and operation as the core, eliminate institutional barriers with the implementation of fair competition review as the core, break the shackles of ideas with the implementation of competition advocacy as the core, and strengthen organizational construction with the improvement of competition law enforcement ability as the core. |
