| 摘要: |
| 运用文献资料法、法理分析法和“属+种差”定义法，系统阐释中国运动员义务的生成逻辑、法理基础与构成要素，构建运动员义务的概念范畴体系。我国运动员义务具有强身份属性、时空伴随性与动态转化性特征，其构成要素包括义务主体、义务客体及义务履行行为，具体范畴可划分为基本义务与体育义务两大类。当前我国仍存在立法尚未全面明确运动员义务内涵与履行规则、体育行政部门单向性管理思维限制运动员履行义务、运动员法律意识淡薄导致主体行为失范等问题。为更好推动我国运动员依法依规履行义务，应厘清运动员义务内涵范畴，强化相关立法解释应对；突破体制机制壁垒，健全运动员义务行业规范标准；全面加强普法教育，提升运动员法律意识。 |

| The Generation Logic, Legal Structure, and Implementation Path of Athletes’ Obligations |

| By using the methods of literature, legal analysis and definition of “genus+species difference”, this paper systematically explains the generation logic, legal basis and constituent elements of Chinese athletes’ obligations, and constructs the conceptual category system of athletes’ obligations. The obligations of Chinese athletes have the characteristics of strong identity attribute, space-time accompanying and dynamic transformation, and its constituent elements include the subject of obligations, the object of obligations and the behavior of obligations; the specific categories can be divided into two categories, including basic obligations and sports obligations. At present, there are still some problems in China, such as the legislation has not fully clarified the connotation and performance rules of athletes’ obligations, the one-way management thinking of sports administrative departments limits athletes to fulfill their obligations, and the weak legal consciousness of athletes leads to the anomie of subject behavior. In order to better promote Chinese athletes to fulfill their obligations in accordance with the law, we should clarify the connotation of athletes’ obligations and strengthen the relevant legislative interpretation; break through the barriers of system and mechanism, improve the standard of athletes’ obligation industry; comprehensively strengthen legal education and enhance athletes’ legal awareness. |
