| 随着体育协会改革的不断深入，体育管理将走向多元共治模式，体育法学相关理论亦需要重新认识与思考，有必要对社会权力语境下的我国体育法学结构变迁展开探讨。介绍不同研究中关于社会权力的概念，以及其与国家权力之间的关系。指出社会权力处于公法与私法的中间状态，是混合型权力形态；宽松的发展空间、多元的文化环境是社会权力运行的条件；交涉与互动是社会权力最根本的规则。认为，体育学的基本理念亟需创新、改造，实现从过去的“秩序”向“正义”转向；体育法学研究范畴应进一步扩展，建立适合我国的“国家—社会”分析框架；服务于传统的社会和社会关系的科层制已经落后，要加强组织结构体系变革研究；体育法正向公法私法化方向发展，体育行政行为亟待重塑；社会权力不能完全适用私法规则，应逐步完善体育行政救济责任条款。 |

| Research on the Structural Change of Sports Law in China under the Context of Social Power |

| With the deepening reform of sports associations, sports management will move towards a multigovernance model, and the relevant theories of sports law also need to be recognized and reconsidered. It is necessary to explore the structural changes of sports law under the context of social power.This paper introduces the concept of social power in different studies and the relationship between social power and state power.It points out that social power is between public law and private law, which is a mixed power form, loose development space and multicultural environment are the conditions for the operation of social power,and negotiation and interaction are the most fundamental rules of social power.The author thinks that the basic idea of physical education needs to be innovated and reformed to realize the transformation from “order” to “justice”.The scope of sports law research should be expanded and establish a “statesociety” analytical framework suitable for China.The bureaucratic system, which serves the traditional society and social relations, has fallen behind, so we should strengthen the research of organizational structure system reform.The sports law is developing in the direction of the privatization of public law, and the corresponding sports administrative behavior needs to be reshaped urgently.Social power can not be fully applied to the rules of private law, and the sports administrative relief liability clause should be improved gradually. |
