| 运动员生物识别数据 (ABD)主要是指与运动员生理特征或生物力学特征有关的事实和信息,较之普通的个人数据,具有唯一性、不可更改性和易获取性,同时运动员生物识别数据具有重要的人格和财产属性,并会波及运动员隐私权、数据自决权、劳动权等基本权利的实现,亟需加强保护。运动员生物识别数据的保护要在坚持严格保护数据主体的立场上,以 “数据控制论”为理论基础,保障运动员在数据处理中自主、自治。在具体对策上,美国职业体育联盟在集体谈判协议中增加数据保护条款提供了有益借鉴,在立法缺失的情况下,可以采取行业规范和合同治理路径,在运动员合同中严格约定生物识别数据的收集和处理。 |

| Abstract: |
| Athlete’s biometric data (ABD) refers to facts and information about an athlete’s physiological or biomechanical characteristics, which are unique, unchangeable, and easily accessible compared to ordinary personal data, and have important personality and property attributes that affect the realization of fundamental rights such as athlete privacy, data self-determination, and labor rights. The protection of athlete biometric data should insist on the position of strictly protecting the data subjects, and use “data cybernetics” as a theoretical basis to ensure the autonomy and self-governance of athletes in data processing. In terms of specific countermeasures, the addition of data protection clauses in collective negotiation agreements by U.S. professional sports leagues provides a useful reference. In the absence of legislation, industry norms and contract governance paths can be adopted, and the collection and processing of biometric data are strictly agreed upon in the athletes’ contracts. |
