| 电子竞技作为一项新兴体育运动,虽然发展迅猛,但备受各类舞弊现象困扰,对运动本身甚至整个社会都有严重危害。所谓电竞舞弊,即在正式比赛中故意或过失使用规则禁止的方法、设备、 物品的行为,包括6个类型。针对电竞舞弊的规制问题,现有的行业自律在主体、范围、对象、立场等方面均存在不足,而相关立法也较为滞后,亟待完善。应以行业自律为基础,建构法律规制的路径,制定或更新规范性文件,明确规制对象,推广电竞运动员注册制度,尽快建立统一的规制主体, 通过 “体育市场黑名单”等制度强化惩戒、完善追责,形成对电竞舞弊行为的有效治理。 |

| On the Regulation of Fraud in E-Sports in China |

| Abstract: |
| As an emerging sport, e-sports, although e-sports develops rapidly, it is plagued by all kinds of fraud phenomena, which does serious harm to the sports itself and even the whole society. The so-called e-sports fraud refers to the intentional or negligent use of methods, equipment and items prohibited by the rules in the formal competition, including six types. For the regulation of e-sports fraud, the existing industry self-discipline has deficiencies in the subject, scope, object and positionand other aspects, and the relevant legislation has lagged behind and needs to be improved urgently. Based on industry self-discipline, we should construct the path of legal regulation, formulate or update normative documents, clarify the regulation object, promote the e-sports athlete registration system, establish a unified regulation subject as soon as possible, and strengthen punishment and improve accountability through “sports market blacklist” and other systems, so as to form an effective governance of e-sports fraud. |
