我国竞技体育薪资争议诉诸体育仲裁研究

摘要:
随着我国竞技体育的不断发展,各种体育纠纷不断,其中以薪资争议最为典型,对此我国主要依赖非专业化的行政机关和体育组织的调解和裁决方式加以解决。目前我国缺失专业化的体育仲裁制度,现行的法律法规对竞技体育纠纷诉诸仲裁的规定流于空泛,相关实践的法理正当性亦有待确认。竞技体育薪资争议具备简明化、专业化、全球化特征,与我国政策走向高度契合,对其诉诸体育仲裁存在可能性。虽然我国短期内无法建立健全独立的体育仲裁制度,但可通过渐进式改革的方式,遵从我国法律创制由简入繁的体系思路,先行引入美国最终报价仲裁制度。从具体实践来说,最终报价仲裁制度本土化需上升至法律的层级,加强对程序的映射,引入合比例性测试。

Abstract:
With the continuous development of competitive sports in China, various sports disputes continue to occur, among which the salary dispute is the most typical. This is mainly resolved by the mediation and adjudication of non-professional administrative organs and sports organizations. At present, China lacks a professional sports arbitration system. The current laws and regulations on the arbitration of competitive sports disputes are vague, and the legal legitimacy of relevant practices needs to be confirmed. The salary dispute of competitive sports has the characteristics of simplification, specialization and globalization, which are highly consistent with China ’s policy, and it is possible to resort to sports arbitration. Although China is unable to establish a sound and independent sports arbitration system in the short term, we can introduce the final offer arbitration system of the United States first through the way of gradual reform and the system thinking of China’s legal creation from simple to complex. From the concrete practice, the localization of the final offer arbitration system needs to rise to the level of law, strengthen the mapping of procedures, and introduce proportionality test.
