| 电竞游戏运行画面性质认定是解决相关著作权纠纷的首要步骤，游戏画面的独创性认定不仅关乎其作品性质，更关涉电竞游戏开发商、电竞主播等主体权益。鉴于司法实践与学界对电竞游戏运行画面独创性的认定存在模糊不清、缺乏体系化等问题，提出，应厘清电竞游戏运行画面独创性的认定路径，建立类型化的独创性认定体系，明确画面元素原创性、元素编排性的认定标准，规范法律适用，以期促进电竞产业蓬勃发展。 |

| The identification of the nature of the running screen of e-sports games is the first step to solve relevant copyright disputes. The originality identification of the e-sports graphics is not only related to the nature of its works, but also to the rights and interests of e-sports game developers, e-sports anchors and other subjects. In view of the problems of ambiguity and lack of systematization in the originality identification of the e-sports graphics in judicial practice and academic circles, it is proposed that the identification path of the originality of the e-sports graphics should be clarified, the categorization identification system should be established, the identification standards of the originality and arrangement of the elements of the graphics should be clarified, and the application of the law should be standardized, so as to promote the more vigorous development of the e-sports industry. |
