| 以人类身体在自然与社会中所处的位置及它们之间的互动为切入点，分析人们的身体观念、身体参与度和体育开展以及体育权确立之间的关联。人们对身体所持有的观念决定体育的活跃程度以及竞技体育的发展高度。人们对身体过多禁忌和过度开放都会限制体育的发展。身体禁忌权的收拢和开放权的行使让体育权利的属性也得以延展。对体育权利属性界定的过程同时也是对身体权利属性界定的过程。总体而言，禁忌是身体权和体育权的自然属性，开放是身体权和体育权的社会属性，而无论禁忌还是开放都需要借助于法律规制手段，在此过程中，法律通过赋权的方式对身体权和体育权进行固化和确证，也使其具有了法律属性。 |

| Abstract: |
| Starting from the position of human body in nature and society and the interaction between them, this paper analyzes the relationship between people’s body concept, body participation, sports development and the establishment of sports rights. people’s concept of body determines the activity of sports and the development of competitive sports. People’s excessive taboo and openness to the body will limit the development of sports. The retraction of body taboo rights and the exercise of open rights extend the attributes of sports rights. The process of defining the attributes of sports rights is also the process of defining the attributes of physical rights. Generally speaking, taboo is the natural attribute of physical rights and sports rights, and openness is the social attribute of physical rights and sports rights. Both taboo and openness need the help of legal regulation means. In this process, the law consolidates and confirms physical rights and sports rights by empowerment, which also makes them have legal attribute. |
